RESERVATION FEE, DEPOSIT, HOLDING FEE & FINAL BALANCE: A $100 reservation fee is collected at the time the Buyer's name is placed on the Breeders waiting lists. If the potential Buyer chooses to place a deposit and an eventual holding fee (as outlined below), the Buyer commits him/herself to the terms of this agreement regardless of whether this document is signed or not. Once the puppies are born, a deposit of $700 is due at birth within 24 hours of the birth announcement email, and the deposit represents the Buyer's commitment to choose a puppy at 5-6 weeks of age. If you choose a puppy a holding fee between $1100 and $1600 is also due (holding fee amount depends on the generation of Cavapoo or Brittanydoodle) which holds the Buyer’s chosen puppy until he/she is 8 weeks old and ready to leave Pleasant Meadows. The holding fee at 5-6 weeks of age is only due if the Buyer chooses a puppy. If the Buyer does not choose a puppy then the Buyer’s original $100 reservation fee and the $700 deposit placed at birth is non-refundable but is transferable as outlined -- the reservation and deposit can be transferred to another waiting list with available spaces, or another litter with available puppies. If the said puppy dies or is found to have a physical defect making it unfit for purchase prior to being transferred to the Buyer, on this premise only will the reservation fee, deposit, and holding fee either be refunded or transferred to another available puppy of equal value (to be determined by the Breeder – Pleasant Meadows) unless the Buyer prefers to pay the difference for a puppy from a different generation. All payments -- reservation fee, deposit, and holding fee must be paid on time -- which is within 24 hours of going on a list, within 24 hours of the birth announcement, and within 24 hours of choosing a puppy as outlined on our website. And the final balance for our puppies must be paid for in full 24 hours in advance of the day that the puppy turns 8 weeks of age, and all puppies must be picked up on the day the litter turns 8 weeks or the closest correlating weekend (to be determined by Pleasant Meadows). If your puppy is not picked up on the day that the litter turns 8 weeks OR the closest correlating weekend -- a $15 per day boarding fee will be applied to the puppy price that covers the cost of food and care, age appropriate training, as well as for the cost of any additional medical expenses (worming medication, vet appointments, vaccinations, etc.) and this will be required to be paid by the Buyer when the puppy is picked up.

 

 

GUARANTEES: We at Pleasant Meadows will make every effort to guarantee that every puppy we sell is in excellent health at the time of purchase. Your puppy will have passed a veterinary health examination prior to leaving Pleasant Meadows and he/she will be a minimum of 8 weeks of age. Upon leaving Pleasant Meadows all of our puppies will have received the 1st vaccine in the series of puppy inoculations from a licensed veterinarian prior to going to their new home, and have been dewormed twice at minimum. Your puppy’s immune system is not fully developed until your puppy has completed the series of puppy shots once the puppy is in your care. Until this time we strongly recommend not taking your puppy to public places. When at the vet's office have them disinfect the exam table and don’t put your puppy on the floor, keep your puppy in a pet carrier and put your puppy directly back in the pet carrier when the vet examination is complete.

 

 

If the Buyer complies with all of the terms contained within this agreement, then the Breeder warrants the health of the puppy for the first 2 years of life against hereditary life-threatening genetic defects involving the heart, liver and kidneys. Hereditary Degenerative Eye Defects, Syringomyelia and Hereditary Mitral Valve Disease, are also warrantied if life threatening. Life threatening is defined as "a genetic abnormality/disorder that will eventually cause the early death of the dog yielding a life expectancy of less than 5 years either by the progression of the disease or by recommended euthanasia unless extensive medical care and surgery are performed beyond the cost of said puppy”.

 

 

This warranty does not cover "innocent" puppy murmurs (also called "growing murmurs") that go away as a puppy grows. Grade 1-2 heart murmurs (which are innocent murmurs) can sometimes be found in puppies during the growing stages and typically disappear by 6 months of age and grade 1-2 heart murmurs are not life threatening or indicative of heart problems in later life. In the event of an actual heart murmur a replacement puppy will not be given unless there is a grade 3-5 heart murmur present at 10 months of age to a maximum of 2 years of age from the puppy's/dog's date of birth. An innocent grade 1-2 heart murmur in no way makes any puppy unfit for sale. This warranty also does not cover DCM (dilated cardiomyopathy) which may share a link associated with grain free diets.  Each Buyer is responsible for choosing their own dog food and Pleasant Meadows is not responsible for non-genetic DCM (dilated cardiomyopathy) in a puppy/dog.

 

 

With the patellas/knees and the hips -- exercise must be monitored and limited during the first 12 months and the Buyer must not engage their puppy in any strenuous activities that may cause undue damage to developing ligaments, joints and bones. Long walks of several miles, repetitious running, jumping from surfaces higher than the height of the puppy, agility, etc. can break down the puppy's cartilage and tendons causing non genetic patellar or hip dysplasia. In the first 12 months do NOT over exercise the puppy or encourage jumping from heights greater than that of the puppy – a replacement puppy will not be given unless there is a grade 3-5 patellar/knee slip present at 10 months of age to a maximum of 2 years of age from the puppy's/dog's date of birth, and patellar luxation or hip dysplasia caused by injury or a nutritional deficit is void of replacement.

 

We start all of our puppies on crate training and we require that all Buyers have their puppy sleep either in a crate or on a dog bed on the floor and *NOT your bed* until at least 6 months of age to avoid any risk of your puppy jumping off or falling off your bed and causing an injury. Jumping or falling from heights greater than themselves WILL cause damage to their ligaments, joints, etc. Any puppy presenting a leg ailment, particularly patellar luxation within the first 8 months will be suspect of injury to that leg and will be void of replacement, as the patellar joint is easily compromised by a fall or other jarring action in growing puppies.  Genetic leg defects do not commonly show up until a dog is of mature weight and height and the joint is stressed. All of our puppies are vet checked at 8 weeks to rule out patellar luxation. We encourage Buyers to bring their puppy’s crate into their bedroom so that they can be close by their puppy throughout the night.

 

 

Buyers also need to be mindful not to over-feed (which could cause excessive/rapid weight gain) and to only feed quality dog food, as these conditions (heart problems, hip and joint dysfunctions) can be brought on by poor quality food which does not promote proper bone/cartilage growth, development, and maintenance. A grossly overweight dog displaying these conditions under 2 years of age will be considered void of a replacement, as there would be no way to accurately determine that the cause of any one of the above conditions could be genetic, and it is the Buyer's responsibility to feed their dog appropriately and not allow their dog to become obese. Appropriate weight relative to your dog's breed and size must be verified by a veterinarian in the event of one of these conditions. The puppy must be fed a nutritionally adequate brand of dog food throughout his/her life – the puppy/dog will be void of replacement if the Buyer feeds inferior quality food containing animal by-products or foods that don’t list meat as the first and second ingredients. If the Buyer changes the food to another brand other than what was supplied in the Puppy Starter Kit sent home with your puppy – the Buyer must switch the food over gradually (10-14 days at minimum) in order to help prevent the puppy from getting an upset intestinal tract which can result in diarrhea and/or vomiting. Switching to another food too quickly can also result in stressing the puppy’s immune system, as the intestines are responsible for the absorption of all nutrients and vitamins, etc. If the intestines become irritated – a host of problems can arise! Any puppy under 1 year of age must also only be fed an ALL LIFE STAGES or PUPPY FORMULA – any puppy that is fed an adult formula under 1 year of age will be void of replacement as there will no doubt be nutritional deficits resulting from feeding adult food while the puppy is still growing.

 

Umbilical hernias do happen from time to time and in most cases are caused by the umbilical cord being pulled by the puppy's mother at the time of delivery which can cause a small tear or weakening in the stomach wall. Hernias are not generally harmful in any way and the most accepted veterinarian recommended course of action is to have a hernia repaired at the time your puppy is spayed/neutered (it's a very simple procedure). If a puppy is found to have an umbilical hernia, this is not considered grounds for a replacement puppy, as it is not breed specific to the Cavalier King Charles Spaniel, Miniature Poodle, or Cavapoo (dogs of all breeds and sizes can get hernias) – and an umbilical hernia in no way makes any puppy unfit for sale. The Breeder will offer a $65 discount off the puppy's price if any one of our puppies is found to have a reducible umbilical hernia at the puppy's veterinarian health examination prior to leaving Pleasant Meadows at 8 weeks of age. Sometimes reducible umbilical hernias are not always visible in young puppies as they are as their name suggests – “reducible”, which means they can disappear and reappear -- and can even appear after 8 weeks of age for numerous reasons including over-exercise and accidental injury.  It’s also possible to have a “fatty deposit” of fluid left behind when the umbilical area closes, and this is not considered a hernia unless the pocket is over 1 cm.  Openings 1 cm or less will likely close by 3-6 months of age and don’t require surgical repair. The discount is for an umbilical opening over 1 cm and does not cover any expenses beyond the $65 (if any), and it does not cover if you decide to or need to have the umbilical hernia repaired prior to having your puppy spayed/neutered. No discount will be given for “outie belly buttons” where a small bubble of fluid forms during the natural healing of the umbilical area after birth as there is no risk of health to the puppy and it is considered to be cosmetic only and would not need to be repaired. The technical term for an “outie belly button” is a “non-reducible hernia” meaning that the herniation has already healed.

 

 

The said puppy, on which the Buyer has placed a deposit, is being sold as a pet only, and must be spayed/neutered between 7 and 12 months of age. We do NOT support early spaying/neutering prior to maturity, as research clearly finds this to be detrimental to them physically and hormonally. If the said puppy/dog is spayed/neutered BEFORE 7 months of age – the puppy will be void of replacement as there are known physical health issues directly associated with altering a puppy before the growth plates close and their body matures. Do NOT allow your vet to bully you into spaying/neutering EARLY – a lot of times they will try to scare you into thinking it has to be done right away – this is NOT the case! Do your research on the BAD effects of spaying/neutering TOO EARLY! If the said puppy/dog is bred without permission from Pleasant Meadows, the Buyer MUST either RETURN the said puppy/dog at their expense to Pleasant Meadows OR if the Buyer wants to KEEP their puppy/dog the Buyer MUST pay for FULL BREEDING RIGHTS and for breaching the contract. Full Breeding Rights and Breech of Contract Fee is $5000. It is NOT difficult to PREVENT unwanted pregnancy in a female – if your female is in heat, keep her on a leash and do NOT let her go outside alone (even in your own yard) and do not take her out on walks (stay in your own yard).  There is no excuse for an “accidental” breeding/pregnancy. We recommend spaying a female between 7-9 months of age and a male between 10-12 months of age.

 

 

This health guarantee is for the first 2 years of life only, and all claims must be submitted before the puppy's second birthday. A replacement puppy will be made, if during this time frame, a puppy is found to have a life-threatening genetic defect identified by two unassociated licensed veterinarians, providing that documented proof from both unassociated veterinarians is sent to Pleasant Meadows for the Breeder’s veterinarian to review. If the Buyer refuses to provide veterinary proof from both unassociated veterinarians of a genetic defect, then Pleasant Meadows is released from all obligations to replace the puppy. A replacement will be made for a puppy of equal value, unless the Buyer prefers to pay the difference for a more valuable puppy. In the unlikely event that a death occurs, a necropsy must be performed by a licensed veterinarian and a copy of the report forwarded to the Breeder for review by the Breeder's veterinarian before determining if a replacement is to be made. If our veterinarian concurs that the puppy did indeed pass away due to a genetic defect, the Breeder will replace your puppy as soon as one is available. All expenses are at the Buyer's expense including the licensed veterinarian tests, professional diagnosis, medications, necropsy, and all applicable medical expenses. If the puppy becomes ill and the owner has the puppy euthanized without the Breeder’s prior consent, no replacement will be made. If the Buyer declines the replacement puppy, then the Breeder shall be under no further obligation and it will be deemed that the Buyer has released the Breeder from any and all further claims, obligations or duty regarding this agreement. There will be no monetary refund, as this guarantee is only for a replacement puppy of the same value if the above requirements of veterinarian proof are met. Again, THE BREEDER SHALL NOT BE RESPONSIBLE FOR MEDICAL EXPENSES OR OTHER COSTS THAT THE BUYER HAS INCURRED, AND NO MONEY WILL BE REFUNDED.

 

This guarantee does NOT cover any costs associated with spaying or neutering, nor does it cover injury or death from any routine surgical procedure. Further, this guarantee does not cover any of the following conditions or minor flaws: coccidiosis, giardia, parvovirus, hypoglycemia, kennel cough, pneumonia, canine influenza, ear mites, ear infections, skin mites, mange (sarcoptic, demodectic or cheyletiella), cherry eye or any other non-life-threatening eye, skin, or tissue issues, allergies, undescended testicles, over or under bites, base narrow canines, teeth extractions, or dental work of any kind, herniations 1 cm or less and/or hernia repair, non-life-threatening bone or joint disorders such as but not limited to luxating patellas, and heart murmurs that are not life threatening. The Breeder cannot guarantee your puppy against any illness or opportunistic parasite brought on by stress of moving to the Buyer's home, or motion sickness brought on by being transported.  It is stressful for any puppy to leave it’s mother and littermates and this stress can result in illnesses or opportunistic parasites such as: giardia, hypoglycemia (low sugar shock), coccidia (dormant in most live animals), kennel cough, etc... the Breeder does not guarantee the puppy to be free of worms as this is an ongoing process.  All puppies and their parents are treated regularly for worms according to our veterinarian's guidelines and continued worming treatments will become the Buyer's responsibility once the puppy is in their care. These are easily and economically treated and should they occur THE BREEDER SHALL NOT BE RESPONSIBLE FOR MEDICAL EXPENSES OR OTHER COSTS THE BUYER HAS INCURRED.

 

 

While we at Pleasant Meadows will make a good faith effort to estimate the colour, and the size of the puppy based on past litters and size of the parents, we DO NOT and CANNOT guarantee size, colour, temperament, fur type, or non-shedding if the puppy is a hybrid breed. This guarantee also does NOT cover behavioral problems as training philosophies and environments vary amongst new owners. Temperament develops as the puppy grows and interacts with it’s new family and environment, and is based on the training the puppy receives from the new owner(s). Pleasant Meadows cannot regulate the training or socialization the puppy/dog receives once it is not in our care, and therefore cannot be responsible for any lack of training which results in unwanted behaviour.

 

 

By signing this purchase agreement the Buyer agrees to provide their new puppy with adequate quality food, water, and shelter throughout the dog's life. At no time shall the said puppy be kept in a kennel or crate for extended and unreasonable periods of time, or left outside in extreme hot or cold weather. The Cavalier King Charles Spaniel, Miniature Poodle, Brittanydoodle and the Cavapoo are indoor dogs and should never be housed outside and should only be kept in your home. It is the Buyer's sole responsibility to properly house train their puppy, and teach their puppy to abide by a set of rules the Buyer chooses for their household, and to seek professional help if any training issues above the Buyer’s experience level arise. The Buyer also agrees to provide the said puppy with routine veterinary care from a licensed veterinarian and to keep the puppy/dog current on vaccines and dewormings as recommended by the Buyer's personal vet.

 

 

Pleasant Meadows does our best to screen people to not only make sure that the Cavapoo, Brittanydoodle, Miniature Poodle, or Cavalier King Charles Spaniel is a good match for you and/or your family, but also to make sure that you are ready for the life-long commitment of raising a puppy and caring for a dog's daily needs. For any reason prior to pickup of your puppy, if we at Pleasant Meadows feel that your home would not be a suitable environment in which to raise a puppy (ie. neglectful, abusive, work schedule will not allow time for a dog, etc.), or we feel it is not in the puppy's best interest, for whatever reason we see fit, we reserve the right to terminate the contract even after a deposit has been placed on a puppy and have no obligation to sell to the Buyer in question. If Pleasant Meadows determines for ANY REASON that the Buyer's home would not be suitable for one of our puppies, this would negate the agreement with the Buyer void and would constitute the return of the deposit on these terms ONLY, as it would be Pleasant Meadows terminating the contract.  If you choose to walk away on your own accord – the deposit is non-refundable.  We encourage everyone considering the purchase of a puppy or dog to ask questions, research, and make changes (if needed) to accommodate a dog in their life.

 

 

In the event that Pleasant Meadows should terminate the contract, return the Buyer’s deposit, and refuse to sell the Buyer a puppy both parties agree that they will not disparage or denigrate each other orally, electronically, or in writing should the Buyer make online derogatory claims. The Buyer agrees to pay all fees to have negative remarks and claims removed from the world wide web. The Buyer shall also be responsible for any costs should the Seller need to enforce removal, including necessary attorney fees, court costs, and fees to the online company to remove the complaint. Any pictures taken by the Breeder are of a professional quality and shall not be altered or shared by the Buyer without permission from Pleasant Meadows. The Buyer also does not have permission to use these photos to sell the puppy to a third party.

 

 

The Buyer is responsible to make all payments on or before 8 weeks of age.  If the Buyer is unable to complete the purchase by 8 weeks of age, the Buyer defaults and understands the said puppy on which the Buyer placed a deposit will no longer be available to the Buyer and the said puppy will be offered to the next family on the Breeder’s waiting list (if any).  By 8 weeks of age, the Buyer should be committed to the said puppy that is being held for them, and if the Buyer backs out last minute the original $100 reservation fee and $700 deposit is non-refundable. Due to the extreme inconvenience directed at the Breeder, who needs to start the screening process all over again for a new family, the holding fee and any additional payments made by the Buyer will not be refunded until after the said puppy has been purchased/paid in full by a new prospective family.  The same also applies should the Buyer neglect to pick up the said puppy by 9 weeks of age, thereby forfeiting the Buyer's rights to the said puppy, and the original $100 reservation fee and $700 deposit placed at birth will be retained by the Breeder.

 

 

If for any reason the Buyer should need to rehome their puppy/dog purchased from Pleasant Meadows, the puppy/dog must be returned to Pleasant Meadows at the Buyers expense, or we must be allowed to help in the rehoming process by choosing a person from our waiting lists to receive the puppy/dog.  As responsible breeders, we want to ensure that all of our puppies are placed in forever homes.  After screening each individual/family, we only sell our puppies under the assumption that a forever home will be provided.  Any rehoming or reselling of our puppies is not permitted.  If an unforeseen circumstance arises and the Buyer can no longer care for the puppy/dog, you must contact Pleasant Meadows for details.

 

 

THIS GUARANTEE APPLIES TO THE ORIGINAL BUYER ONLY, AND IS NOT TRANSFERABLE. THERE ARE NO OTHER GUARANTEES EXPRESSED OR IMPLIED EXCEPT AS CONTAINED HEREIN. This agreement is made to protect both purchaser and seller.  We will do all we can to insure you receive a healthy and happy puppy.
